Terms of Service

By commissioning me, you agree to these terms.

You must be 18+ to commission me. No exceptions.

You're encouraged to provide a details visual and/or written reference of any characters you'd like included, and prepare a general idea of the scene/expression you're looking for. Additional concept sketches, regardless of skill level, are appreciated and welcome. You could literally send me stick figures and it would be helpful.

All commissioned pieces will be in digital form only. You will receive one image with my signature placed in such a way that it doesn't obscure the artwork. I will not remove my signature but I can move it if the placement isn't to your liking.

Please save your commission to your device so you do not lose access to them. After two months I can't guarantee I will have retained a copy of your commission.

Any commissioned work is for personal use only. This means zero commercial usage is allowed. This includes, but is not limited to, merch, posters, prints, digital sales, NFTs, crypto, promotion, charity, logos, etc. Please discuss with me if you would like to use your commission for business or commercial reasons as there will be additional fees involved depending on the use.

You may use commissioned work to make merchandise for giveaways, trades, and other personal use, but you cannot sell it. If you're unsure if your intended use falls under the definition of commercial use, please ask.

I do not allow my artwork to be put into an AI database or through AI generators. By commissioning me, you agree to never use my artwork for the purposes of AI imaging, generation, training, etc.

You are not permitted to make edits to any artwork I have created without explicit, written permission from myself. This includes writing on the artwork, changing colours, etc. You may crop the artwork to use for icons or thumbnails on social media sites. You are permitted to add a personal watermark to the image as long as my signature remains visible.

You are not permitted to make any claims of ownership or creation of the artwork I have made. Doing so will see you blacklisted.

When reposting artwork you have purchased to your own galleries, you *must* credit me and link back to my corresponding socials; meaning if you upload the artwork to your Twitter, please credit/tag my Twitter account, if you upload to ToyHou.se, please credit my ToyHou.se account, etc. If a corresponding social does not exist, please link back to this website. You can find me as DigitalPopsicle on Twitter, FurAffinity, Instagram, TikTok, Aethy, Bsky, deviantArt, and Toyhou.se, and as Digital_Popsicle on Twitch.

I reserve the right to upload the piece to my socials and galleries, use it as promotional material, in a portfolio, etc. If the customer prefers it stays private then they *must* specify before work on the piece begins as there may be an additional charge.

I also reserve the right to refuse any commission without needing to provide a reason. In this case the customer will be refunded in full if any payment has been made.

Payment must be made in full before I will begin working. Payments in installations or partial payments won't be accepted. I only accept payments via PayPal, and I don't accept e-cheques.

Once I have started work on the commission I will no longer issue full refunds. If I have not begun working on your commission, I will issue a full refund. If I have begun working on your commission, you may receive a partial refund dependant on how much work has been completed. This is at my discretion.

I aim to finish commissions in 6-8 weeks and will endeavour to inform of any delays. You're welcome to check up on progress at any point, though I ask please do not do so in a harassing way. I work full time in addition to doing commission work.

I will endeavour to show at least one sketch of the work during its progress to confirm the position and design. I will only continue this sketch with approval. After this sketch has been approved I cannot guarantee any modifications to the artwork.

You get one major revision and two minor revisions at the sketch stage if you have given me specific visual reference poses to work with. Major revisions include moving several body parts, how the characters interact, the overall pose, etc. Minor revisions include small limb positioning (hands, ears, tail, etc), hair, clothes, etc.

If you have given me artistic freedom or no visual pose reference then I will not make any major changes to the pose.

If you have purchased artwork on a premade base/sketch (such as YCH work), I can't guarantee I will show you a progress sketch. Please request this if you want to be sure. I will also not accept any major revisions to the sketch with premade bases.

Revisions to the sketch once it has reached the lineart stage may be subject to additional charges if you wish to modify it as it requires me re-drawing it.

I reserve the right to re-use any rejected sketch ideas for other commissions or artwork.

Upon delivery of the work, I'm happy to make small tweaks and changes to the finished piece as long as it doesn't require parts of it to be redrawn. This can include colour tweaks, missing markings, etc. I reserve the right to decline modifications if I feel they are too complex.

These terms may update and change at any point.
